Koehler law punishes those who commit fertility fraud

SPRINGFIELD – State Senator Dave Koehler championed a new law that will outlaw fertility fraud in Illinois.

When Bloomington resident Curt Richardson got his DNA test results back from Ancestry.com in June 2021, his life – and those of his parents – changed forever when they learned they had been victims of fertility fraud.

Richardson’s story is similar to hundreds of others across the state and nation who have lived most of their lives thinking the very people who raised them were their biological parents. State Senator Dave Koehler is working to bring awareness to fertility fraud and provide justice to the families who fall victim to the heinous act.

“Fertility fraud is a horrific crime, and the health care professionals who commit such acts deserve to face dire consequences,” said Koehler (D – Peoria). “These acts have gone unpunished for too long.”

Fertility fraud occurs when a health care provider knowingly or intentionally uses their own human reproductive cells during an assisted reproductive treatment without the patient’s informed written consent.

Senate Bill 380 creates the Illinois Fertility Fraud Act, which allows people to bring action against health care providers who commit fertility fraud.

The measure provides a civil cause of action for donor fertility fraud against health care providers who treat patients for infertility using donated human reproductive material without consent. It also states that any child born as a result of fertility fraud is entitled to a qualified protective order allowing the child access to the personal medical records and health history of the person who committed the fraud.

“This crime has caused trauma for countless families across our state,” said Koehler. “It’s time we take a stand against this heinous crime.”

Senate Bill 380 was signed into law Friday and goes into effect Jan. 1, 2024.

protonbeam 080123SPRINGFIELD – To improve patient access to proton therapy, State Senator Dave Koehler led a measure that will provide coverage for cancer treatment using proton beam therapy that was signed into law Friday.

“Cancer patients deserve to have access to every available treatment,” said Koehler (D-Peoria). “This high-precision radiation therapy treatment helps preserve healthy tissue, which may give folks a better outcome.”

Proton beam therapy is an advanced cancer radiation therapy that uses focused beams to target nearly the exact depth and location of cancerous cells in the body, delivering a higher dose to the tumor and less to the surrounding healthy tissue. Under Koehler’s law, cancer treatment using proton beam therapy will be covered by insurance.

Koehler protects Illinoisans from price gouging of generic medication

SPRINGFIELD – Drug manufacturers and distributors will now be unable to spike the costs of generic medication thanks to a law spearheaded by State Senator Dave Koehler.

“Every Illinoisan deserves affordable access to necessary medication,” said Koehler (D-Peoria). “This law prevents companies from robbing residents just for an extra buck.”

House Bill 3957 creates the Illinois Generic Drug Pricing Fairness Act, which prohibits manufacturers and distributors from engaging in price gouging of essential off-patent and generic medication.

“We need to stake a stand for our residents and prohibit companies from these manipulative schemes,” said Koehler. “There should never be a situation when someone has to decide between picking up their medication or groceries for their family.”

House Bill 3957 was signed into law Friday and goes into effect Jan. 1, 2024.

State Senator Dave Koehler was pleased to see that $243.5 million in investments will directly impact Peoria and Tazewell Counties.

SPRINGFIELD – State Senator Dave Koehler passed a law to highlight future career opportunities for children living with disabilities.

“Children living with disabilities and their families often feel as if there aren’t many job opportunities after graduation,” said Koehler (D – Peoria). This new law will empower children living with disabilities with opportunities to be successful in our state’s workforce.”

Under House Bill 3224, students with individualized education plans – or IEPs – and their parents will be provided information on the school district’s career and technical education and dual credit opportunities.

SPRINGFIELD – State Senator Dave Koehler passed a measure to create awareness of the history of the Underground Railroad in Illinois.

“Illinois played a significant role towards the path of freedom that has usually gone unnoticed,” said Koehler (D – Peoria). “This task force will bring to light the efforts Illinoisans went through to help slaves on their journey, and map the route across the state.”

Senate Bill 1623 creates the Underground Railroad Task Force. The group will develop a statewide plan to connect existing local projects and new projects to create a cohesive statewide history of the Underground Railroad in Illinois, while developing new educational and tourism opportunities.

The task force will identify where historical sites are located, connections they may have to one another, and will paint a picture to recognize the history of the Underground Railroad in Illinois. It will also introduce educational and tourism opportunities throughout the state.

“People shouldn’t have to burn a hole in their wallets to receive the medication they need,” said Koehler (D – Peoria). “This legislation will ensure that every Illinoisan has access to medication at a fair price.”

House Bill 3957 creates the Illinois Generic Drug Pricing Fairness Act, which would prohibit manufacturers and distributors from engaging in price gouging of essential off-patient and generic drugs.

“It’s time we hold these companies accountable for what should be considered robbery,” said Koehler. “Medication shouldn’t be priced at ridiculous rates to the point where people are turned away.”

House Bill 3957 passed the Senate Health and Human Services Committee Tuesday. It now heads to the full Senate for further consideration.
