SPRINGFIELD – State Senator Mike Porfirio advanced legislation aimed at addressing flood-related concerns for tenants by adding disclosure requirements when a property is located in a flood hazard area or a lower-level unit has experienced flooding.

“It is our responsibility to advocate for secure housing environments for our residents,” said Porfirio (D-Lyons Township). “By championing policies that prioritize awareness, we can protect renters while strengthening our communities against the challenges of flooding.”

Currently, only seven states require some disclosure of flood risk to renters. Porfirio’s measure would equip potential tenants with essential information about flood risks before renting the property, fostering a fair and informed rental market.

Through the measure, property owners would be required to disclose to every potential tenant if a property is located in a high-risk flooding area. Property owners who rent out lower-level units – such as garden, basement and first floor units – would also have to indicate to tenants if one of those units has flooded within the last 10 years. All disclosures would need to be given in writing prior to signing the lease.

“Better transparency can empower tenants with crucial information about flood risks and support responsible property management,” said Porfirio. “Disclosure builds trust, and requiring disclosure for vulnerable units demonstrates our dedication to protecting tenants from the unpredictable forces of nature.”

Senate Bill 2601 passed the Senate Judiciary Committee on Tuesday and moves to the full Senate for further consideration.
